An export authorisation is required depending on which product, understood in a broad sense (cf. what is an export), the exporter wishes to export.
In general, there are three criteria concerning the product which decide whether an export authorisation is necessary:
- The control list: is the product on the EU control list of critical products?
- Catch-all: may the product be used in the development or production of WMD or is it a matter of military application in a country under an arms embargo, even if the product is not listed?
- Technical assistance: EU has decided that technical assistance i.e. transfer of critical know-how or technology may also be subject to the export authorisation requirement. These rules have been implemented into Danish law in 2005.
