There is no export authorisation requirement for products which are only listed in Annex I of the control list, as these exports are covered by the Internal Market.

But, if a product listet in Annex I is transferred to a customer in another EU Member State the customer must be informed about export controls and that the product might be subject to controls if re-exported (see article 22, paragraph 10, in the Council Regulation No. 428/2009).

Export authorisations are only required with regard to intra-Community transfers of dual-use products and technology if:

  • The product is listed in Annex IV of the control list to the EU regulation (most sensitive products)
  • The product is subject to the catch-all provisions, and the exporter is aware that the product is to be re-exported and used in a third country.
