What to do
Start by reading the Regulation on Industrial Co-operation in Denmark.

Due to the regulation the Danish Enterprise and Construction Authority (DECA) encourages potential foreign suppliers to initiate contact with Danish industry as early as possible when bidding for a contract with the Danish Armed Forces.

Implications
The regulation has the following implications for suppliers of equipment exceeding DKK 100 million:

Contracts with Danish companies covering at least 30 per cent of the procurement value must be signed no later than 4 years after signing the contract with the Danish Armed Forces.

Contracts for more than 30 per cent within the first 4 years will be rewarded with a reduction in the total obligation. If for example contracts are signed for 40 per cent within the first 4 years, the total will be reduced from 100 per cent to 90 per cent and if the figure is 50 per cent, the total obligation will bee reduced to 80 per cent etc. Hence signing contracts for 65 per cent of the total obligation within 4 years correspond to 100 per cent fulfilment. 

If, on the other hand the obligation to sign contracts covering at least 30 per cent has not been fulfilled within the first 4 years, the remaining amount of the 30 per cent has to be issued in a bank guarantee to DECA. This obligation is to be covered by an irrevocable "on demand" guarantee provided 3 years after signing the contract with the Danish Armed Forces.

If the guarantee is not provided, DECA can exclude foreign suppliers from obtaining contracts with the Danish Armed Forces.

How to proceed

  1. Contact DECA and inform of the coming procurement.
  2. Download the standard ICC 1 and fill in the blanks.  
  3. Forward two signed copies of the ICC 1 to DECA. If acceptable, DECA will retain one of the copies for its own records and sign the other copy and forward it to you.
  4. DECA must have the signed ICC 1 no later than 30 days prior to the contract signing with the Danish Armed Forces.

Once an ICC has been established, DECA will inform the Danish Armed Forces that your company and DECA have entered into an ICC and that the Danish Armed Forces can now sign a contract with you.
