In the EU, the overall legal basis for export controls is established in the form of a regulation based on the common commercial policy (Article 133 of the EC Treaty). Via the regulation, the decisions are implemented which are taken in the four international export control regimes: The Wassenaar Arrangement, the Australia Group, MTCR and NSG.

Furthermore, the EU has a coordinating role in relation to the four export control regimes as it is the EU that updates and publishes a general control list of all the products subject to export controls on the basis of agreements made in the four international export control regimes.

As the Danish authority in charge of the dual-use area, the Danish Enterprise and Construction Authority participates in a number of meetings in the EU, where the EU regulation, revision of the control list and a number of other matters concerning the EU regulation and the administration of it are on the agenda.

Also among the EU Member States themselves, there is coordination activity prior to the meetings in the four export control regimes.
